Following a productive meeting with Westchester County, City of Mount Vernon attorneys appeared in court to put an end to the City Council’s Temporary Restraining Order that prohibited renovation and clean-up and Memorial Field.

In terms of Memorial Field and the Council’s attempt to stop work, Judge Loehr modified the TRO to provide that the Comptroller may pay for work relating to Memorial Field, including, without limitation, Capital Industries and Cornerstone Environmental. The Judge further modified the TRO to provide that all City entities (Mayor, Comptroller, City Council) may perform any necessary act to comply with the IMA, as amended. The City’s objection to the continuation of the TRO was noted on the record, as well as the City’s request that the matter be dismissed as non-justiciable and moot. Judge Loehr adjourned the matter until October 2nd, 2018.

With regard to the Kela Tennis matter, the Judge directed Kela Tennis to withdraw their request for injunction relief. They did so on the record and the Judge then vacated the TRO and directed that the case be assigned to the preliminary conference part.

The topic of Memorial Field arose at the August 22nd 2018 Special Board of Estimate and Contract meeting. Comptroller Deborah Reynolds commented that she was “very happy” that the vast majority of the City Council’s TRO was vacated. City Council President Lisa Copeland agreed with Comptroller Reynolds and noted that the TRO was made when she was “out of town”.
